Terms of Service

Last updated: May 22, 2026. These terms govern your relationship with Snow Canada Holdings Inc. (operating as snow.ca).

Terms

The agreement between you and snow.ca.

1. Acceptance

By requesting a quote, signing a service agreement, renting equipment, purchasing supplies, or accessing the snow.ca operator cabinet, you agree to these Terms of Service. If you do not agree, do not use the services. Specific services may have additional terms in your signed contract; those control where they conflict with this document.

2. Services offered

  • Snow removal & ice control — residential, commercial, municipal, ad-hoc
  • Equipment — snow blowers, plows, salt spreaders, melters, shovels (sale + rental)
  • Supplies — ice melt, rock salt, calcium chloride, brine, deicer
  • Operator cabinet — dispatch, GPS, photo proof, invoicing software
  • Marketplace — listings of used snow equipment from third parties (we are not a party to those transactions)

3. Service agreement & SLAs

Commercial accounts receive a signed service agreement specifying trigger depth, response time, salt application rate, and pricing. Default commercial SLA: ≤ 4 hours from a 2 cm accumulation trigger unless otherwise specified. Residential accounts are billed per visit or per season; please refer to your quote for specifics.

4. Payment & billing

  • Commercial: net-30 from invoice date unless otherwise agreed
  • Residential: pre-paid seasonal or per-visit credit card on file
  • Late payments accrue interest at 1.5%/month (19.56% APR)
  • Disputes must be raised in writing within 30 days of invoice
  • Refunds for missed visits are credited within 10 business days

5. Customer obligations

  • Identify hazards (low gas meters, sprinkler heads, fragile landscaping) before service starts
  • Mark service boundaries with stakes or reflectors during the first snowfall
  • Provide gate codes, key access, or parking instructions in writing
  • Keep service areas clear of vehicles, debris, and pets during scheduled visits
  • Notify snow.ca of property changes (new structures, regraded areas) before next service

6. Insurance & indemnification

snow.ca carries a $5M general liability policy on every commercial account and $2M errors-and-omissions on the management layer. We indemnify customers against bodily-injury and property-damage claims arising from negligent performance of contracted services, subject to the documentation standards (photo proof, dispatch logs, salt rate confirmation) maintained by the operator cabinet. We do not indemnify against claims arising from customer-supplied incorrect site information, pre-existing hazards, or services performed outside our agreement.

7. Slip-and-fall claims

Slip-and-fall claims must be reported to snow.ca within 24 hours of the alleged incident. We will provide dispatch logs, photo proof, and salt-application records relevant to the location and time. Customer must preserve any video footage available. snow.ca's defence record is maintained in part by this documentation; failure to notify within 24 hours may impair defence.

8. Limitation of liability

Except for indemnification obligations under Section 6, snow.ca's total liability for any claim is capped at the fees paid by the customer for the service giving rise to the claim in the 12 months preceding the claim. snow.ca is not liable for indirect, consequential, special, or punitive damages, including lost profits or business interruption, except where prohibited by Canadian consumer-protection law.

9. Equipment rental terms

Renters are responsible for fuel, daily inspection, and damage beyond normal wear. Damage waiver is available at booking. Skid-steer rentals require a valid operator certification on file. Equipment must be returned at the agreed time; late returns are billed at 1.5× the daily rate.

10. Marketplace

Used-equipment listings on snow.ca/marketplace are posted by third-party sellers. snow.ca is not a party to those transactions and provides the listings as a service. Buyers and sellers transact directly. snow.ca's involvement is limited to listing facilitation and is governed by separate marketplace terms shown at listing time.

11. Operator cabinet (software)

Operator cabinet access is licensed per active dispatcher seat. Customers retain ownership of their dispatch data; snow.ca retains ownership of the software platform. Account export is available on request and on termination.

12. Termination

  • Either party may terminate with 30 days' notice unless the signed service agreement specifies otherwise
  • snow.ca may terminate immediately for non-payment past 60 days
  • On termination, customer pays for services rendered through the termination date and snow.ca delivers final photo proof and dispatch logs

13. Governing law & dispute resolution

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Disputes that cannot be resolved by good-faith discussion will be referred to mediation in Toronto, Ontario, before any litigation. The forum for any litigation is the courts of Ontario.

14. Changes

Material changes to these terms will be notified to active customers by email at least 30 days before taking effect.
